In 2024, there were 10 pro-abortion ballot initiatives attempting to codify a right to abortion, along with a lone initiative in Nebraska seeking to establish protections for life that ran counter to a pro-abortion initiative.

Tragically, almost all of the pro-abortion initiatives succeeded. However, life triumphed in three states — Florida, Nebraska, and South Dakota — which became the first states to defeat pro-abortion ballot initiatives. The success in Florida was particularly miraculous: In the face of being outspent $110 million to $3 million, the pro-life movement prevailed. Added to this massive $110 million figure is another $27 million spent on gathering signatures to place Amendment 4 on the ballot. In short: Despite spending at least $137 million on Amendment 4, Planned Parenthood, the ACLU, with support from George Soros, failed to reach the threshold to amend the Florida Constitution.

A similar victory occurred in Nebraska: Not only did Nebraska defeat a pro-abortion initiative, but it was the only state in the nation with a counter-pro-life measure on the ballot as well. Nebraska now constitutionally protects unborn life after the first trimester.

While three abortion amendments failed, seven amendments succeeded in Arizona, Colorado, Maryland, Missouri, Montana, Nevada, and New York.

These amendments are particularly decisive because they change the state's constitution, overriding previous state abortion laws, and can only be reversed by voters through a different ballot measure. Most of the pro-abortion amendments decided on election night involved sweeping, and often vague, undefined language that will have drastic effects in the states that ratified them.

The 2026 Ballot Battles

But the fight isn't over.

As the 2026 election looms, Liberty Counsel Action will continue to battle at the state level to protect the unborn in our nation, working with coalitions to repeal and replace amendments in states that passed Abortion Amendments, as well as ensure this agenda is defeated in all remaining states.
