WASHINGTON, D.C. — Since May 2025, Liberty Counsel Action (LCA) has elevated the issue of abortion-related contaminants in the nation’s water supply to the highest levels of the federal government through LCA’s initiative: “Abortion in Our Water” (AIOW). As a result, this overlooked environmental and public health concern is now receiving attention from the nation’s most influential agencies and policymakers.
Considering that potentially hundreds of thousands of abortions are taking place at home, LCA has raised concerns in an 98-page special report about how aborted human fetal remains and potentially active metabolites from the abortion pill Mifepristone—known to act as an “endocrine disruptor”—are being flushed into the nation's water systems where they may not be filtered out by conventional wastewater treatment plants.
In just nine months, LCA has met with officials from the Environmental Protection Agency, the Department of Health and Human Services, the White House Domestic Policy Council, and key congressional offices to recommend action on this critical issue. These efforts have already yielded significant results. Most notably, the Make America Healthy Again (MAHA) Commission’s strategy report recommended continued research on ways to improve water quality, which aligns with LCA’s recommendation for research on how abortion-related contaminants may be affecting water quality.

Specifically, the MAHA commission directs the EPA and the U.S. Department of Agriculture to assess water contaminants and recommends that agencies include “gold-standard research” on the “levels of pharmaceuticals in our water supply that could be adversely affecting animal and human health.” LCA’s actions and results regarding its outreach for the AIOW initiative from May 2025 through January 2026 also include:
Public Advocacy Resources
- Launched the AIOW website with resources for congressional staffers and others, including a Toolkit for those who would like to advocate or speak to their lawmakers on this topic.
Environmental Protection Agency (EPA)
- Met with EPA officials over multiple meetings, including EPA Administrator Lee Zeldin.
- EPA acknowledged environmental concerns related to Mifepristone and its metabolites.
- EPA staff signaled interest in further meetings and potential actions.
White House / Domestic Policy Council
- Made several briefings and follow up calls with White House staff.
- Language in the White House MAHA strategy document that references pharmaceuticals in water resulted from these meetings.
Health and Human Services (HHS)
- Briefed senior HHS official within Secretary Robert F. Kennedy Jr.’s office and secured follow up meetings.
Congressional Activity
- Hand delivered LCA’s special report to members of Congress.
- Assisted in preliminary discussions for a potential environmental subcommittee hearing.
- Actions contributed to the inclusion of Mifepristone related language in an Appropriations report that encourages the EPA to include Mifepristone metabolites in its “Unregulated Contaminant Monitoring” to study and track in wastewater and drinking water.
- Submitted written testimony on the health and environmental concerns with chemical abortion drugs to the January 2026 Senate Health, Education, Labor & Pensions Committee hearing on the dangers of abortion drugs.
State Level Involvement
- Drafted a letter to the Florida Attorney General requesting enforcement of fetal disposal laws.
- Working with state legislators on related legislation.
